What personal information do we process? When you use our Services, we process:

Do we process any sensitive personal information? We do not intentionally solicit or require sensitive personal information (such as social security numbers or health data). Do you receive any information from third parties? We may receive information from public databases, marketing partners, and social media platforms. We also receive data (responses) back from the AI model providers you interact with through our interface.

How do you process my information? We process your information to provide our Services (including relaying your prompts to AI models), to maintain your chat history for your future access, to communicate with you, for security, and to comply with the law. We do not use your Service Content to train our own models.

In what situations and with which types of parties do we share personal information? To provide the Service, we must share your prompts and uploaded content with the third-party AI model providers you select (e.g., OpenAI, Anthropic, Google). We may also share data with service providers who help us with billing or infrastructure.

How do we keep your information safe? We have organizational and technical processes and procedures in place to protect your personal information. However, no electronic transmission over the internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information.

What are your rights? Depending on your location, you have rights regarding your data access and portability. Unique to SUNWÆE: You have the right to delete your chat history at any given time through SUNWÆE interface. When you choose to delete a chat, it is effectively a "hard delete" — the data is permanently removed from our active databases and is not merely archived or hidden.

How do I exercise my rights? The easiest way to exercise your rights is by deleting your chats from SUNWÆE interface at https://sunwaee.com or by contacting us at privacy@sunwaee.com.

1. WHAT INFORMATION DO WE COLLECT?

Personal information you disclose to us

In Short: We collect personal information that you provide to us, including your account data and the content you input into our AI tools.

We collect personal information that you voluntarily provide to us when you register on the Services express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.

Personal Information Provided by You. The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use. The personal information we collect may include the following:

  • Account Data: Email addresses
  • Service Content: We collect the prompts, queries, messages, and files you provide to the Services in order to facilitate your interactions with AI models ("Service Content").

Sensitive Information. We do not proactively solicit or require sensitive personal information (e.g., social security numbers, health data, or religious beliefs). However, because our Services involve processing text and files provided by you, we may inadvertently process sensitive information if you choose to include it in your prompts or uploads. All such data is treated with the same high level of security as your other Service Content.

Payment Data. We may collect data necessary to process your payment if you make purchases, such as your payment instrument number and the security code associated with your payment instrument. Application Data. If you use our application(s), we also may collect the following information if you choose to provide us with access or permission:

  • Mobile Device Access. We may request access or permission to certain features from your mobile device, including your mobile device’s storage (for file uploads to AI models) and camera (for image-to-text features).
  • Mobile Device Data. We automatically collect device information (such as your mobile device ID, model, and manufacturer), operating system, and system configuration information.
  • Push Notifications. We may request to send you push notifications regarding your account or certain features of the application(s).

Information automatically collected

In Short: Some information — such as your Internet Protocol (IP) address and/or browser and device characteristics — is collected automatically when you visit our Services.

We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location (usually based on IP), information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.

2. HOW DO WE PROCESS YOUR INFORMATION?

In Short: We process your information to provide our AI aggregation services, maintain your chat history, communicate with you, ensure security, and comply with the law. We do not use your prompts to train our own models without your consent.

We process your personal information for a variety of reasons, depending on how you interact with our Services, including:

  • To provide and facilitate the delivery of Services. We process your Service Content (prompts and uploads) to relay them to the third-party AI model providers you select and to display the resulting outputs back to you.
  • To maintain your chat history. We store your chat sessions so that you can access, continue, and manage your interactions across different devices. These are subject to our "Hard Delete" policy—if you delete them, they are gone from our active databases.
  • To enable user-to-user interactions. We may process your information if you choose to use features that allow for communication or collaboration with other users, such as sharing chat links, collaborative workspaces, or community features.
  • To facilitate account creation and authentication. We process your information so you can create and log in to your account, as well as keep your account in working order.
  • To fulfill and manage your orders. We may process your information to fulfill and manage your subscriptions, payments, and credits through the Services.
  • To respond to user inquiries/offer support. We may process your information to respond to your inquiries and solve any potential issues you might have with the Services.
  • To send administrative information to you. We may process your information to send you details about our products and services, changes to our terms and policies, and other similar information.
  • To protect our Services. We may process your information as part of our efforts to keep our Services safe and secure, including monitoring for automated abuse or fraudulent use of AI credits.
  • To identify usage trends. We may process information about how you use our Services (e.g., which models are most popular) to better understand how they are being used so we can improve them.
  • To request feedback. We may process your information when necessary to request feedback and to contact you about your use of our Services.
  • To save or protect an individual’s vital interest. We may process your information when necessary to save or protect an individual’s vital interest, such as to prevent harm.

3. WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR INFORMATION?

In Short: We only process your personal information when we believe it is necessary and we have a valid legal reason (i.e., legal basis) to do so under applicable law, like with your consent, to comply with laws, to provide you with services to enter into or fulfill our contractual obligations, to protect your rights, or to fulfill our legitimate business interests.

If you are located in the EU or UK, this section applies to you.

The General Data Protection Regulation (GDPR) and UK GDPR require us to explain the valid legal bases we rely on in order to process your personal information. As such, we may rely on the following legal bases to process your personal information:

  • Performance of a Contract. We may process your personal information when we believe it is necessary to fulfill our contractual obligations to you. This includes:

    • Transmitting your prompts to AI model providers to generate responses.
    • Storing your chat history so you can access it across devices.
    • Managing your subscription, billing, and AI credit balances.
  • Consent. We may process your information if you have given us permission (i.e., consent) to use your personal information for a specific purpose, such as when you opt-in to marketing communications or choose to make a chat "public" for other users to see. You can withdraw your consent at any time.

  • Legitimate Interests. We may process your information when we believe it is reasonably necessary to achieve our legitimate business interests, provided those interests do not outweigh your fundamental rights. These interests include:

    • Fraud Prevention: Monitoring for credit card fraud or automated abuse of our AI API resources.
    • Service Improvement: Analyzing usage patterns to determine which models or features are most effective for our users.
    • Security: Diagnosing technical problems and preventing "jailbreaking" or other malicious activity that could jeopardize our infrastructure or our relationships with model providers.
    • User Support: Responding to your inquiries and technical issues.
  • Legal Obligations. We may process your information where we believe it is necessary for compliance with our legal obligations, such as to cooperate with a law enforcement body or regulatory agency, or to disclose information as evidence in litigation.

  • Vital Interests. We may process your information where we believe it is necessary to protect your vital interests or the vital interests of a third party, such as situations involving potential threats to the safety of any person.

In legal terms, we are generally the “data controller” under European data protection laws of the personal information described in this privacy notice. If you are using SUNWÆE as an individual, we determine the means and purposes of the processing.

If you are located in Canada, this section applies to you.

We may process your information if you have given us specific permission (i.e., express consent) to use your personal information for a specific purpose, or in situations where your permission can be inferred (i.e., implied consent). You can withdraw your consent at any time.

In some exceptional cases, we may be legally permitted under applicable law to process your information without your consent, including, for example:

  • For investigations and fraud detection and prevention.
  • If disclosure is required to comply with a subpoena, warrant, or court order.
  • If we have reasonable grounds to believe an individual has been, is, or may be a victim of financial abuse.
  • If it is reasonable to expect collection and use with consent would compromise the availability or the accuracy of the information and the collection is reasonable for purposes related to investigating a breach of an agreement or a contravention of the laws of Canada.

4. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

In Short: We may share information in specific situations described in this section and/or with the following categories of third parties.

Vendors, Consultants, and Other Third-Party Service Providers. We may share your data with third-party vendors, service providers, contractors, or agents (“third parties”) who perform services for us or on our behalf and require access to such information to do that work. We have contracts in place with our third parties designed to help safeguard your personal information. The categories of third parties we may share personal information with are as follows:

  • AI Model Providers: To fulfill your requests, we send your prompts and uploaded content to third-party AI model providers (such as OpenAI, Anthropic, Google, and others). These providers act as sub-processors. We utilize enterprise-grade API agreements where available to ensure your data is not used to train their foundational models.
  • Cloud Computing Services: We use providers like AWS, Google Cloud, or Vercel to host our platform and infrastructure.
  • Data Storage Service Providers: We use secure database providers to store your account information and chat history.
  • Payment Processors: We use third-party services like Stripe to process your subscription and credit payments.
  • Performance Monitoring & Data Analytics: We use tools like Sentry or PostHog to monitor app performance, identify crashes, and understand aggregate usage trends.
  • Communication & Collaboration Tools: We may use third-party services to send you administrative emails or support notifications.

We also may need to share your personal information in the following situations:

  • Other Users: When you choose to use the collaboration features of the Services—such as sharing a chat via a link, inviting a user to a workspace, or posting to a public gallery—your information (such as your username and the shared content) will be visible to those who have access to that shared space.
  • Business Transfers: We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
  • Affiliates: We may share your information with our affiliates, in which case we will require those affiliates to honor this privacy notice.
  • Legal Obligations: We may share your information with government entities or law enforcement when required by law or to protect the safety and integrity of our platform.

5. WHAT IS OUR STANCE ON THIRD-PARTY WEBSITES?

In Short: We are not responsible for the safety of any information that you share with third-party websites or services that we may link to, or that are generated within our Services.

The Services may link to third-party websites, online services, or mobile applications that are not affiliated with us. Additionally, because the Services aggregate various AI models, those models may generate responses containing links to external websites.

Accordingly, we do not make any guarantee regarding any such third parties, and we will not be liable for any loss or damage caused by the use of such third-party websites, services, or applications. The inclusion of a link towards a third-party website, service, or application does not imply an endorsement by us. We cannot guarantee the safety and privacy of data you provide to any third parties. Any data collected by third parties is not covered by this privacy notice. We are not responsible for the content or privacy and security practices and policies of any third parties, including other websites, services, or applications that may be linked to or from the Services. You should review the policies of such third parties and contact them directly to respond to your questions.

6. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

In Short: We do not use traditional tracking cookies. We use local storage and similar technologies to maintain your session and improve your experience.

We do not use cookies to track your behavior across the web. Instead, we use Local Storage (a technology that allows us to store data locally on your browser or device) primarily to store your authentication tokens. This allows you to stay logged into your account without having to re-authenticate every time you open the Services.

We may also use similar tracking technologies (like web beacons or pixels) through our third-party analytics and performance monitoring providers to understand how you interact with our Services and to help us identify and fix technical issues.

7. HOW DO WE HANDLE YOUR SOCIAL LOGINS?

In Short: We do not currently offer the ability to register or log in through third-party social media accounts.

Our Services currently require you to register directly with an email address. We do not provide options to log in using social media platforms (such as Facebook, Twitter, or Google). If we decide to implement social logins in the future, this section will be updated to reflect how those providers share information with us.

8. IS YOUR INFORMATION TRANSFERRED INTERNATIONALLY?

In Short: We may transfer, store, and process your information in countries other than your own, primarily Canada and the United States.

Our servers are located in Canada. If you are accessing our Services from outside Canada, please be aware that your information may be transferred to, stored, and processed by us in our facilities in Canada.

However, because SUNWÆE is an AI aggregator, your Service Content (prompts and uploads) must be transferred to the third-party AI model providers you select (such as OpenAI or Anthropic) to generate a response. Most of these providers are located in the United States.

International Transfer Safeguards:

  • Canada Adequacy: For our users in the EEA and UK, Canada is recognized by the European Commission as providing an adequate level of protection for personal information transferred from the EU to Canadian organizations.
  • Standard Contractual Clauses (SCCs): For transfers to our third-party AI providers in the United States, we rely on Standard Contractual Clauses (SCCs). These are legal contracts that require the recipients to protect your personal information in accordance with European and UK data protection standards.
  • Provider Frameworks: While we are not personally certified under the Data Privacy Framework (DPF), we prioritize selecting AI providers that are certified or provide equivalent enterprise-grade data protection agreements.

9. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this privacy notice unless otherwise required by law. When you delete a chat, it is permanently removed from our active database.

We only keep your personal information for as long as it is necessary for the purposes set out in this privacy notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements).

User-Controlled Retention:

  • Chat History: We store your chat history so you can access it across sessions. You have full control over this data.
  • The "Hard Delete" Policy: When you choose to delete a chat or a specific message through the SUNWÆE interface, we perform a "hard delete." This means the data is immediately and permanently removed from our active databases. We do not simply "archive" or hide your data with a flag; once you delete it, we cannot recover it for you.
  • Account Deletion: If you decide to delete your account, all associated personal data and chat history will be permanently deleted from our active systems immediately.

Automated Retention: When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

10. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.

11. DO WE COLLECT INFORMATION FROM MINORS?

In Short: We do not knowingly collect data from or market to children under 18 years of age.

We do not knowingly solicit data from or market to children under 18 years of age. By using the Services, you represent that you are at least 18 years of age. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records using our "hard delete" protocols.

12. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: In some regions, such as the European Economic Area (EEA), United Kingdom (UK), and Canada, you have rights that allow you greater access to and control over your personal information. You may review, change, or terminate your account at any time.

In some regions (like the EEA, UK, and Canada), you have certain rights under applicable data protection laws. These may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; and (iv) if applicable, to data portability. In certain circumstances, you may also have the right to object to the processing of your personal information. You can make such a request by contacting us by using the contact details provided in the section “HOW CAN YOU CONTACT US ABOUT THIS NOTICE?” below.

Exercising Your Rights: You can make such a request by contacting us using the contact details provided in the section “HOW CAN YOU CONTACT US ABOUT THIS NOTICE?” below. We will consider and act upon any request in accordance with applicable data protection laws.

Self-Service Erasure: Note that you can exercise your right to erasure (the "right to be forgotten") at any time by using the delete functions within the SUNWÆE interface. As noted in Section 9, deleting a chat or message results in a permanent "hard delete" from our active databases.

Withdrawing your consent: If we are relying on your consent to process your personal information, you have the right to withdraw your consent at any time. You can withdraw your consent by contacting us or, where applicable, by adjusting your account settings. Please note that this will not affect the lawfulness of the processing before its withdrawal.

Opting out of marketing and promotional communications: You can unsubscribe from our marketing and promotional communications at any time by clicking on the unsubscribe link in the emails that we send or by contacting us. You will then be removed from the marketing lists. However, we may still communicate with you for service-related messages that are necessary for the administration and use of your account (e.g., password resets or billing updates).

Account Information: If you would at any time like to review or change the information in your account or terminate your account, you can:

  • Log in to your account settings and update your user profile.
  • Use the "Delete Account" option within the application settings.

Upon your request to terminate your account, we will deactivate and perform a "hard delete" of your account and all associated chat history from our active databases. We may retain a limited record of the transaction for legal compliance, fraud prevention, or to resolve disputes.

Cookies and similar technologies: As noted in Section 6, we primarily use Local Storage to maintain your session tokens. Most Web browsers are set to accept these by default. If you choose to clear your Local Storage or reject these technologies, it will result in you being logged out and may affect the functionality of the Services.

13. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.

14. DO CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

In Short: Yes, if you are a resident of California, you are granted specific rights regarding access to your personal information.

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes.

SUNWÆE does not sell your personal information or share it with third parties for their direct marketing purposes.

In addition, under the California Consumer Privacy Act (CCPA), you have the following rights:

  • Right to Know: You can request to know what personal information we have collected about you.
  • Right to Delete: You can request the deletion of your personal information (which you can also perform yourself via our "hard delete" feature).
  • Right to Non-Discrimination: We will not discriminate against you for exercising your privacy rights.
  • Right to Correct: You may request that we correct inaccurate personal information.

Notice at Collection: We collect your email address, account credentials, and the Service Content (prompts) you provide. We use this information to provide the Services, maintain security, and improve our platform. We do not collect "Sensitive Personal Information" as defined by California law (like precise geolocation or social security numbers).

15. DO VIRGINIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

In Short: Yes, if you are a resident of Virginia, you may be granted specific rights regarding access to and use of your personal data.

Under the Virginia Consumer Data Protection Act (VCDPA):

“Personal Data” means any information that is linked or reasonably linkable to an identified or identifiable natural person. “Personal data” does not include de-identified data or publicly available information.

Your Rights Under the VCDPA:

  • Right to Access: You have the right to confirm whether we are processing your personal data and to access that data.
  • Right to Correct: You have the right to correct inaccuracies in your personal data.
  • Right to Delete: You have the right to delete personal data provided by or obtained about you.
  • Right to Opt-out: You have the right to opt-out of the processing of your personal data for purposes of targeted advertising, the sale of personal data, or profiling. Note: SUNWÆE does not sell your personal data or use it for targeted advertising.

Exercising Your Rights: The easiest way to exercise your rights is through your account settings in the SUNWÆE app. For any other requests, you may contact us at privacy@sunwaee.com.

Appeals Process: If we decline to take action regarding your request, you have the right to appeal our decision by emailing us at privacy@sunwaee.com. Within 60 days of receipt of an appeal, we will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions.

16. DO WE MAKE UPDATES TO THIS NOTICE?

In Short: Yes, we will update this notice as necessary to stay compliant with relevant laws.

We may update this privacy notice from time to time. The updated version will be indicated by an updated “Revised” date and the updated version will be effective as soon as it is accessible. If we make material changes to this privacy notice, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to review this privacy notice frequently to be informed of how we are protecting your information.
